Understanding BAC Levels and Their Impact on Your DUI Case

When someone is arrested for driving under the influence in Colorado, one of the first numbers that comes up is their Blood Alcohol Concentration, or BAC. As the owner of Christian A. What is BAC?

Blood Alcohol Concentration represents the amount of alcohol in a person’s bloodstream. In Colorado, as in most states, the legal limit for drivers over 21 is 0.08%. For commercial drivers, it’s 0.04%, and for drivers under 21, any BAC over 0.02% can result in penalties under Colorado’s zero-tolerance laws. These thresholds are strict, and prosecutors rely heavily on BAC readings to pursue DUI charges.

However, BAC is not as straightforward as it may seem. Factors like body weight, metabolism, how much food you’ve eaten, and even stress levels can influence how alcohol affects you. Two people can drink the same amount, and one might be over the legal limit while the other is not. This complexity is often overlooked when cases rely solely on a BAC number.

How BAC is Measured

In Colorado DUI cases, BAC is typically measured using a breathalyzer test or a blood test. Breathalyzers are more common because they provide immediate results, but they are also more prone to error. Improper calibration, medical conditions, or even certain diets can affect accuracy. Blood tests are generally more reliable but require proper handling and chain of custody to ensure valid results.

If BAC reaches 0.15% or higher, Colorado considers it a “persistent drunk driver” offense, bringing harsher penalties like longer license suspensions, mandatory alcohol education, and possible ignition interlock device requirements.
