Leaving a vehicular accident scene may seem tempting at the time, but doing so could put you in serious hot water that only a good Colorado DUI defense attorney can get you out of. Even if you know you are at fault and possibly facing serious consequences, you’re better off staying on the scene and cooperating with authorities once they arrive. Your attorney can take care of the rest.
Colorado Hit and Run Law
In Colorado, a driver involved in an accident that results in injury to or death of any person is required by law to stop his vehicle at the scene of the accident. If he is unable to stop his vehicle at the scene for any reason (such as if a nearby vehicle bursts into flames), he must stop the vehicle as close to the scene as possible and return to the vicinity and wait for police arrive. The driver must provide his name, address, and vehicle registration number to an officer on the scene and display his driver’s license to the person struck or driver/occupant of the vehicle he collided with. The driver must also provide assistance such as getting (or carrying) the injured person to a hospital if necessary or requested by the injured person. If the injured person is not capable of receiving driver information from the driver, the driver must report the accident. A driver will not be charged with a hit and run if he leaves the scene of an accident for the purposes of reporting it.
Failure to report or leaving the scene of an accident can result in serious charges, especially if the accident resulted in death. In addition, you will lose your driver’s license. A qualified Colorado Springs DUI defense attorney can advise you how to best address the serious charges that may result from leaving the scene of a DUI accident.
